Juez decide que padre de hija que lucha contra el cáncer es retenido ilegalmente y merece ser liberado

Un juez federal ha dictado que un nacional mexicano, detenido el fin de semana pasado en Niles, Illinois, por agentes de inmigración, fue retienen ilegalmente y merece una audiencia de fianza.

El 40 años Rubén Torres Maldonado, de quien se dice que es ciudadano no del país, ingresó en los Estados Unidos el año 2003, ha vivido con su pareja de 20 años en Chicago desde entonces y trabaja como pintor. Tiene dos hijos ciudadanos estadounidenses: una de ellos tiene 4 años mientras que la otra tiene 16.

La hija de Torres Maldonado, Ofelia Giselle Torres Hidalgo, es diagnosticada con rabdomiosarcoma alveolar metastásico y ha recibido quimioterapia y radioterapia. Su abogados dijeron al juez que su hija no puede continuar con el tratamiento debido a los estrés y la interrupción causadas por el arresto de su padre.

Un médico también informó al juez que "el cuidado médico complejo y continuo de Ofelia requiere el apoyo de sus padres en un momento muy difícil".

El abogado del Departamento de Justicia, Craig Oswald, dijo que las autoridades de inmigración no estaban dispuestas a liberar a Maldonado de forma voluntaria porque "no había cooperado" durante su arresto y, supuestamente, puso a los agentes "en peligro".

Sin embargo, el juez Jeremy Daniel ordenó una audiencia de fianza para Maldonado el viernes. El juez agregó que "el debido proceso requiere una audiencia de fianza" y dijo que no hay disputa sobre que Torres Maldonado "ya estaba en el país".

This whole situation is pretty messed up 🤔... I mean, a guy who's been living in the US for over 20 years with his family, working and paying taxes, gets arrested by ICE just because they're not sure if he's a citizen or not? It doesn't make sense to me. And let's be real, the fact that the immigration authorities were so quick to jump into action without even trying to verify Torres Maldonado's citizenship status is suspicious. But I guess that's the whole point of having a judge like Jeremy Daniel who sees through all this nonsense. He ordered an appearance bond for Torres Maldonado because he knows that the man is innocent until proven guilty, and that due process requires some basic human rights to be respected. I'm so glad to see the justice system in action 🙌! This case is totally unacceptable, but at least now Rubén Torres Maldonado will get a chance to prove his innocence and be with his family again ❤️. I mean, can you imagine having to deal with cancer treatment for your kid while your partner is being held by the authorities? 😱 It's just not right. The fact that his daughter, Ofelia, was put on hold during her treatment due to her dad's arrest is heartbreaking 🤕.

I also think it's crazy that Craig Oswald's team claimed that Rubén wasn't cooperative during his arrest and put agents in danger 🤷‍♂️. What exactly does "not cooperating" mean in this situation? Is he supposed to just roll over and accept being deported because he didn't speak English fluently or something? 🙄

😔 This is so sad 🤕, a dad of two US citizens (🇺🇸) is being detained by ICE 🚫 and it's having a huge impact on his sick daughter 👧. I mean, can't they see that this arrest is causing her more stress 😷 and disrupting her treatment? 💉 The fact that she can't even finish chemo due to the arrest is just heartbreaking ❤️. And what about the dad's art 🎨, he needs his creative outlet to cope with all this! 🤯 I hope Rubén gets a fair hearing and can be reunited with his family soon 👪. This whole situation is just a huge mess 😩, we need to do better for people like him who are just trying to make a life in the US 🌎.
 
this is just a setup for another headache, some poor dude gets arrested by immigration agents and now his kids are suffering 🤕... like, what's the point of even having an audience of bail if they're just gonna keep holding him? and what about his medical kid, she needs her parents to be there for her but now they're stuck in this limbo. and those immigration agents, always looking for ways to create drama. "he put us in danger"... give me a break 🙄

The judge finally saw sense and granted this guy bail 💼. I hope he can get back to being with his family ASAP and can focus on getting better for his daughter 💕. This is what's wrong with our immigration system - it's so broken 🤦‍♀️. We need to start treating people with dignity and compassion, not locking them up like they're some kind of threat 🚫.
