US judge orders release of Kilmar Abrego Garcia from immigration detention

Federal Judge Orders Release of Man Wrongfully Deported by Trump Administration

In a significant victory for immigrant rights advocates, a federal judge in Maryland has ordered the release of Kilmar Abrego Garcia from immigration detention. The ruling comes after Garcia was wrongfully deported to El Salvador by the Trump administration in March 2020.

Abrego Garcia, who entered the US as a teenager without documentation, had been re-detained multiple times since his initial deportation due to the efforts of Immigration and Customs Enforcement (ICE). However, on Thursday, US District Judge Paula Xinis ruled that Garcia's detention was unlawful, citing "judicial activism" by the Department of Homeland Security.

In her decision, Judge Xinis stated that Abrego Garcia had been re-detained without lawful authority since his return to the US. As a result, she granted his petition for immediate release from ICE custody.

Garcia's case has become a rallying point for critics of President Trump's hardline immigration policies. In 2019, an immigration judge ruled that Abrego Garcia could not be deported to El Salvador due to danger posed by a gang targeting his family. The Trump administration, however, continues to seek his deportation to another country.

In addition to the court battle over his deportation status, Abrego Garcia is also facing charges related to human smuggling stemming from a 2022 traffic stop. He has pleaded not guilty and filed a motion to dismiss the charges, claiming vindictiveness on the part of prosecutors.

Judge Xinis's ruling marks a significant turning point in the case, as she stated that Trump lawyers had "affirmatively misled" the court by falsely claiming that Costa Rica had rescinded an offer to accept Garcia. This development has sparked further controversy and raised questions about the Trump administration's use of deportation policies to punish individuals for speaking out against its actions.

Abrego Garcia's lawyer has announced plans to reopen his immigration case in an effort to seek asylum in the US. The decision is seen as a major win for immigrant rights advocates, who have long argued that the Trump administration's deportation policies are unconstitutional and unfair.

man this is crazy ๐Ÿคฏ he was literally held back by trump's admin and now a judge is stepping in to set him free it's like they're finally acknowledging what we all knew was wrong about their policies ๐Ÿ˜” Abrego Garcia's story is so messed up, being re-detained multiple times just for trying to live his life in the us ๐Ÿคทโ€โ™‚๏ธ at least he gets another chance now and I'm glad to see immigrant rights advocates fighting for him ๐Ÿ’ช and yeah it's not just about him either, this ruling opens up a lot of other possibilities for people who've been wronged by trump's admin too ๐ŸŽ‰

๐Ÿค It's about time someone held the Trump admin accountable for their draconian immigration policies! ๐Ÿšซ This ruling is a huge victory not just for Kilmar Abrego Garcia but for all the people who've been wrongfully deported or mistreated by this administration ๐ŸŒŸ. The fact that they tried to manipulate the court with false info about Costa Rica's offer is just staggering ๐Ÿ˜ฑ. I'm so glad Judge Xinis saw through their tactics and gave justice to someone who was in dire need of it ๐Ÿ’ฏ. Now, let's see how this sets a precedent for future cases... ๐Ÿค”

just got this news and i'm low-key freaking out ๐Ÿคฏ!!! judge xinis slayed ๐Ÿ’โ€โ™€๏ธ her ruling on kilmar abrego garcia's case is everything - wrongfully deported by trump admin in 2020, but still being held in detention? that's just not right ๐Ÿ˜”. the fact that he was re-detained multiple times because of ice's efforts is just awful ๐Ÿคข. and now, his lawyer's gonna reopen his immigration case to seek asylum... this is a major win for immigrant rights advocates and i'm all about it ๐Ÿ’–. can't wait to see how this plays out ๐Ÿ‘€

๐Ÿ˜Š this judge is a total hero, no doubt about it! I mean, Kilmar Abrego Garcia got sent back to El Salvador when he was just a teenager, without even having proper papers... and now the court's coming down on the Trump administration for messing with his rights. It's like they said: "justice delayed is justice denied"... this guy's been in detention for years because of that! ๐Ÿคฏ

๐Ÿ™Œ this judge gotta do her job right? Abrego Garcia was wrongly deported by the previous admin and it's crazy they made him re-detain multiple times... his lawyer should totally reopen his immigration case for asylum, he deserves a second chance after all that trauma. ๐Ÿค about those human smuggling charges tho, I don't think it's cool how prosecutors are piling on additional charges... like, shouldn't the gov focus on deporting ppl who actually broke laws? ๐Ÿšซ

๐Ÿ˜Š just saw this news about Kilmar Abrego Garcia being released from detention... according to stats, since 2017, there's been a 35% increase in deportations under the Trump admin ๐Ÿ“ˆ meanwhile, studies show that 75% of immigrants who are deported return to the US within 5 years ๐Ÿ“Š let's put this into perspective: as of 2022, 40% of all detention beds were filled with individuals who've been detained multiple times ๐Ÿšซ what does it say about our immigration policies? ๐Ÿค” btw, did you know that in 2019, the US had over 11 million undocumented immigrants living here... and guess how many of them got detained? ๐Ÿคฏ 70% ๐Ÿ‘€

omg ๐Ÿคฏ this is like, amazing news! justice finally served after years of wrongful detention. Kilmar Abrego Garcia has been through so much already, being deported to El Salvador & then re-detained multiple times... it's crazy how far he had to fight for his rights. and now the judge ruling in his favor is like, a huge win for immigrant rights advocates everywhere ๐ŸŒŸ! the fact that Trump lawyers tried to pull a fast one on the court by claiming Costa Rica rescinded its offer to accept Garcia speaks volumes about the admin's desperation to punish people who speak out against their policies ๐Ÿค”. this decision gives Abrego hope of finally getting asylum in the US, which is like, a huge victory for him & his family โค๏ธ can't wait to see what happens next!

๐Ÿค” this ruling just feels like the tip of the iceberg... all these deportation cases from trump era still got pending... what about the others who got wrongly deported or detained? it seems like judge xinis is giving a reprieve but where was their support 4 years ago when abrego garcia was being held without rights? ๐Ÿคทโ€โ™‚๏ธ

๐Ÿ˜Š This ruling is super good news for people like Kilmar Abrego Garcia who've been caught up in the chaos of Trump's immigration policies... I mean, come on, wrongfully deported? That's just not right ๐Ÿ™„. It's about time someone stood up to the DHS and said that's not okay. The fact that a judge had to go all out to set him free is just crazy - but at least now he can finally be reunited with his family in the US ๐ŸŒˆ. And for Abrego Garcia, it's a new chance to reopen his immigration case and maybe even get asylum... fingers crossed for him! ๐Ÿ’•

๐Ÿ˜ฉ๐Ÿ’” another wrongful deportation victim gets justice... kinda sorta? ๐Ÿคทโ€โ™‚๏ธ so kilmar abrego garcia was wrongfully deported to el salvador in march 2020, but it took a federal judge over 5 years to finally rule that he should be released from detention... that's like, forever for someone who's already been traumatized by being separated from their family ๐Ÿค• meanwhile, the trump admin is still trying to deport him to costa rica because of some made-up deal that never happened ๐Ÿ™„ and now garcia's lawyer is trying to reopen his immigration case to seek asylum... it's a small win for immigrant rights advocates, but let's be real, there are millions more people out there who are still struggling with this messed up system ๐Ÿ˜ฉ

๐Ÿค” This guy's been in the system for ages, already re-deported like 3 times, and now some judge says it was all a big mess... but what about the charges? Did he even do anything wrong in 2022? It seems like everyone just wants to jump on the "Trump is bad" bandwagon. What if Trump's policies saved lives? I mean, we're talking about El Salvador here, that country's got some serious gang issues. ๐Ÿคทโ€โ™‚๏ธ

omg can u believe this ๐Ÿคฏ?! some judge just released this dude kilmar abrego garcia from detention cuz he was wrongly deported by trump ๐Ÿ˜ฑ like what even is happening here? he was re-detained multiple times for no reason, and now the court is all like "nah, you gotta go" ๐Ÿšซ meanwhile, his lawyer's trying to reopen his immigration case so he can get asylum in the us... it's a major win for immigrant rights, but also super confusing ๐Ÿ’โ€โ™€๏ธ u feel me?

anyway, i'm loving the part where judge xinis called out trump lawyers for being dishonest ๐Ÿ™…โ€โ™‚๏ธ like, can't we all just have nice things? ๐Ÿ˜Š it's gonna be interesting to see what happens next in this case... keep following along! ๐Ÿ‘€

omg u guys can't even believe it!!! a judge just ordered the release of a guy who was wrongly deported by trump ๐Ÿคฏ meanwhile his lawyer is already planning to reopen his case to seek asylum in the us ๐Ÿ’ฅ what's next??!! i mean, the fact that he was re-detained multiple times without lawful authority is wild ๐Ÿ”’ and the part about trump lawyers misleading the court is just crazy ๐Ÿ˜ฒ i'm all for immigrant rights advocacy and now this judge is basically speaking truth to power ๐Ÿ’ช can't wait to see what happens next!!! ๐Ÿš€

Wow ๐Ÿ˜ฎ! This judge is like a superhero for immigrants right now ๐Ÿ’ช. I mean, can you believe how wrongfully deported someone was just because of their immigration status? It's insane. And for it to happen under Trump's admin, that's just crazy talk ๐Ÿคฏ. I'm glad this guy is finally getting his freedom back and I hope his case gets resolved soon ๐Ÿ‘.

omg ๐Ÿ˜ฉ this is like so good news 4 ppl whos lives r b4 deportations ๐Ÿคฏ kilmar abrego garcia was wrongfully deported by trump admin in march 2020 & now he gets 2 go free!! ๐Ÿ™Œ judge paula xinis r a total hero ๐Ÿ™ she said trumps lawyers lied 2 the court about costa rica accepting him ๐Ÿšซ cant believe trump ppl would do that. abrego garcia's case is like, super important 4 immigrant rights advocates & i'm so glad his lawyer plans 2 reopen his immigration case 2 seek asylum ๐Ÿคž this is like, a major win 4 the people ๐Ÿ‘

๐Ÿ˜Š this judge sound like total activist ๐Ÿคฃ what's with all these rules about deportation? it just seem like trump admin doin wrong thing and they get caught ๐Ÿ™„ cant we just give people chance to live here already? ๐Ÿคทโ€โ™‚๏ธ also, how many ppl have died from gang violence in el salvador? seems like trump just tryin out some kinda twisted experiment ๐Ÿšซ

omg this is insane ๐Ÿคฏ kilmar abrego garcia was literally wrongfully deported by trump admin 5 years ago and now he gets to go free ๐Ÿ™Œ it's crazy to think about how many ppl like him have been through the same thing without justice. his story is super inspiring tho ๐Ÿ’• and i hope this sets a precedent for other cases like his. immigrants rights advocates have been fighting tirelessly for yrs, and it's finally paying off ๐Ÿ™
